Classifies intentionally killing a child born alive during an abortion as murder or attempted murder under New York Penal Law sections 125.25 or 110.05

Explicitly exempts the mother from any criminal prosecution under this act, including for violations, attempts, or conspiracies

Allows mothers to bring civil lawsuits against violators for actual damages, statutory damages equal to three times the abortion cost, punitive damages, and attorney's fees
