Requires hospitals and organizations that collect, process, store, or distribute human milk to comply with Human Milk Banking Association of North America standards unless the Department of Health approves alternate standards

For-profit breast milk banks may only accept milk from mothers who are at least 180 days postpartum and must wait at least 28 days after receiving milk before paying participating mothers

For-profit breast milk banks must work with community-based lactation support groups to provide breastfeeding education and ensure participating mothers' own children are adequately nourished first

At least 50% of breast milk collected by for-profit banks from a locality must be distributed to New York State hospitals for NICUs, nonprofit milk banks, or foster/adoptive parents in the state

For-profit banks must conduct annual audits demonstrating compliance with distribution requirements and submit reports to the Department of Health by January 31st each year, with fines for non-compliance credited to infant mortality prevention projects
