Allows school boards in New York to use state or local funds to purchase whole milk (at least 3% milk fat) or reduced fat milk (2% milk fat), including flavored varieties, produced and processed entirely within New York State

Requires the Attorney General to bring civil action on behalf of schools to recover any federal funds withheld as a result of schools exercising this milk purchasing option

Mandates the Commissioner of Education to notify all school superintendents and administrators about the new milk purchasing provisions

Requires a report to the governor and legislature within two years detailing which schools participated, changes in milk consumption, and state actions to promote milk availability

The law automatically expires if federal law (National School Lunch Act) or Dietary Guidelines for Americans are updated to permit whole or reduced fat milk in schools
