AI Summary

  • Cities, towns, and villages must permit residential construction at a minimum density of 25 dwelling units per acre on any residentially-zoned land within one-half mile of a covered transportation facility

  • Covered transportation facilities include non-seasonal rail stations served by NJ Transit, MTA, Metro-North, or Port Authority located between 0.5 and 60 miles from a city with over one million people, as well as Long Island Rail Road stations outside such cities and bus stops with designated rider parking

  • Local governments cannot impose restrictions that effectively prevent such development, including limits on height, setbacks, floor area ratios, or parking requirements

  • Protections remain for buildings designated as historical sites under state or federal historic preservation acts, and the bill does not override environmental review or fire prevention/building code requirements

  • Aggrieved parties may bring legal proceedings in state supreme court to compel local government compliance if applications are denied or not acted upon, with the act taking effect one year after becoming law
