Requires licensed healthcare providers, hospitals, and other entities performing surgical procedures that need insurance pre-approval to notify patients if any part of their treatment will be provided by out-of-network providers

Mandates notification be delivered via telephone, email, or text message at the time of approval, with written confirmation by mail within 24 hours of the surgical procedure approval

Imposes financial penalty on providers who fail to notify patients at least 48 hours before the procedure: the provider must cover the cost as if services were rendered by an in-network provider

Exempts emergency surgical procedures performed within 24 hours after a patient sustains an injury requiring surgery

Takes effect 90 days after becoming law
