Shifts the regulatory standard from commissioners deeming telehealth services "appropriate" to only allowing commissioners to exclude services they specifically deem "inappropriate"

Maintains existing requirement that telehealth services be reimbursed at the same rate as equivalent in-person services under Medicaid

Excludes facility fees from telehealth reimbursement when services are not provided in a facility or clinic setting

Takes effect 60 days after becoming law and expires alongside the existing telehealth reimbursement provisions in public health law section 2999-dd
