Allows direct support staff in non-facility based programs certified by the Office for People with Developmental Disabilities to perform certain nursing-related tasks under instruction from service recipients, family members, or household members following a practitioner's ordered care

Requires a registered professional nurse to determine which tasks direct support staff may perform based on task complexity, staff skill/experience, recipient health needs, and the family's ability to provide training

Mandates separate annual certification for direct support staff performing medication administration, tube feeding, or diabetic care, with completion of training required by OPWDD

Prohibits direct support staff from assessing medication needs, performing tasks outside a licensed practical nurse's scope of practice, or representing themselves as licensed nurses

Requires criminal and background checks for new hire direct support staff before service begins; takes effect 18 months after passage and expires July 1, 2030
