Expands in-state tuition eligibility at SUNY institutions to non-residents who have attended New York high schools, community colleges, or a combination for two or more years of full-time attendance, or who have three or more years of high school coursework plus three years of elementary/secondary school attendance in New York

Allows non-residents to qualify for in-state tuition rates if they have resided in New York for at least one year and in their specific county, city, or school district for at least six months prior to registration

Defines full-time attendance as a minimum of 420 class hours per school year for high school or 12 credit units per semester (or 420 class hours per year) for community college

Requires students without lawful immigration status to file an affidavit stating they have applied or will apply to legalize their status when eligible, and certifying they meet the residency requirements

Creates an alternative pathway for refugees and asylees who can demonstrate residency requirements through employment authorization documents, I-94 arrival records, or immigration court decisions granting asylum or withholding of deportation
