Removes the current seasonal limitation (May 1 - November 15) on state liability for highway defects, making the state liable year-round for damages caused by defective state highways

Requires that the state must have received actual or constructive notice of highway defects before liability attaches

Applies only to highways maintained by the state under the system adopted by the commissioner of transportation

Maintains existing exemption protecting the state from liability for defects in bridges over which it has no control

Takes effect immediately and applies to causes of action accruing on or after the effective date
