Authorizes James Unger, a Town of West Seneca police officer and member of the NY State and Local Police and Fire Retirement System, to receive service credit under section 384-d of the Retirement and Social Security Law for his employment with the Erie County Sheriff's Department from January 21, 2003 to September 6, 2006

Requires Unger to file a tier reinstatement application with the retirement system and pay all associated reinstatement costs before receiving the service credit, with the request due within one year of the act's effective date

Assigns all past service costs, estimated at approximately $176,000 as a one-time payment, to the Town of West Seneca

The bill will not increase the Town of West Seneca's future annual contributions to the retirement system

Service credit was not previously granted for reasons not attributable to Unger's own negligence, as deputy sheriff service is not normally creditable under the twenty-year police and fire retirement plan
