Grants Daniel Rizzo retroactive Tier II membership in the New York State and Local Police and Fire Retirement System, with a membership date of October 19, 2009 when he was first employed by the Monroe County Sheriff's Office

Rizzo, currently a Tier 5 member employed by the City of Rochester, was not enrolled in the retirement system when first hired through no fault of his own

Requires Rizzo to file an application with the retirement system within one year of the act's effective date to receive the retroactive membership

Entitles Rizzo to a refund of employee contributions he made that would not have been required under Tier II status

Creates a one-time past service cost of approximately $56,500 to be paid by New York State, plus an estimated $9,100 annual increase in contributions from the City of Rochester
