Smith previously had six years and five months of service credit as a Tier 4 member in the NYC employee retirement system, then paid contributions as a Tier 6 member while employed at the Putnam County District Attorney's office from January 2016 through March 2023

Covers the refund period from January 13, 2016 through July 12, 2019, when she initiated a tier reinstatement that was not established with a proper cessation date

Requires Smith to file an application for the refund within one year of the act's effective date

Estimated immediate past service cost of approximately $17,800 as of February 1, 2026, to be shared by New York State and local participating employers in NYSLERS
