Removes the provision allowing surrogate's courts to declare a person ineligible to act as a fiduciary solely because they cannot read and write English

Retains court discretion to declare individuals ineligible if they have been convicted of a felony adverse to the welfare of the estate

Felonies that may disqualify someone include embezzlement, misappropriation of money, or breach of fiduciary duty

Amends Section 707 of the Surrogate's Court Procedure Act, previously amended in 2021

Takes effect immediately upon passage
