Expands eligibility for Medicaid personal care services to individuals with traumatic brain injury, cognitive impairment, developmental disability, blindness, or visual impairment

Lowers the qualification threshold for these newly covered conditions to match the existing standard for dementia/Alzheimer's patients: needing supervision with more than one activity of daily living (rather than limited assistance with more than two activities)

Applies to both the personal care services program under section 365-a and the Consumer Directed Personal Assistance Program (CDPAP) under section 365-f of the social services law

Eligibility requirements remain subject to federal financial participation availability and must be determined using an evidence-based validated assessment instrument approved by the commissioner

Takes effect immediately upon enactment
