Expands the conditions non-public residential health care facilities must meet to withdraw up to 5% of total reported annual revenue without prior notification to the health commissioner

Requires facilities to have been compliant with minimum staffing levels over the two preceding quarters for which relevant data is available to the department

Prohibits notification-free withdrawals for facilities in the Centers for Medicare and Medicaid Services special focus facility program or subject to denial of payment for new admissions

Bars facilities from the exemption if they have been subject to enforcement action by the department or CMS in the previous 18 months that resulted in a finding of deficiency

Delays the effective date of certain provisions in the 2025 law on equity withdrawals (S. 5369/A. 2051) by one year after enactment
