Increases the penalty for rape in the first degree from a class B felony to a class A-II felony

Class A-II felonies in New York carry a minimum sentence of 3-8 years and a maximum of life imprisonment, compared to class B violent felonies which carry 5-25 years

Makes technical language changes replacing "he or she" with "such person" throughout the statute

Applies to rape involving forcible compulsion, physically helpless victims, victims under 11 years old, or victims under 13 when the perpetrator is 18 or older

Takes effect immediately upon passage
