Prohibits New York state and local law enforcement agencies from detaining individuals who are otherwise eligible for release solely because they have entered or are residing in the U.S. in violation of federal immigration laws

Creates an exception allowing detention for individuals convicted of a violent felony offense as defined in the state penal law

Creates an exception allowing detention for individuals convicted within the past five years of specific misdemeanors, including third-degree assault, sexual misconduct, forcible touching, unlawful imprisonment, and endangering the welfare of a child

Additional qualifying misdemeanors include reckless endangerment, sexual abuse in the second degree, killing or injuring a police animal, harming a service animal, and endangering an incompetent or physically disabled person

Takes effect immediately upon enactment
