Establishes new "due care" requirements for drivers overtaking bicycles in cities with populations under one million, towns, and villages, replacing the previous "safe distance" standard

Requires drivers to move to another lane when passing cyclists or pedestrians if safely possible and compliant with traffic laws

Mandates a minimum three-foot passing distance when changing lanes is not possible or would violate traffic laws

Allows drivers to pass cyclists or pedestrians only when "reasonable and prudent" if neither lane change nor three-foot distance requirements can be met

Maintains the existing "safe distance" standard for cities with populations of one million or more (New York City), and takes effect 180 days after becoming law
