Prohibits landlords from evicting tenants from residential units based on their certified medical use of medical marijuana as defined under New York Public Health Law

Establishes a legal defense for tenants in eviction proceedings if the landlord seeks possession solely because of the tenant's certified medical marijuana use

Allows landlords to rebut the defense by demonstrating they are seeking possession on other lawful grounds unrelated to medical marijuana use

Preserves landlords' rights to pursue eviction for any legitimate reason not based on or derived from a tenant's certified medical marijuana use

Takes effect immediately upon enactment
