Prohibits tampering with, removing, or disabling emission control devices on motor vehicles, as well as selling, distributing, possessing, or installing aftermarket defeat devices designed to bypass emission controls

Imposes civil penalties of $1,000-$5,000 for first violations and $2,000-$10,000 for subsequent violations of emission tampering prohibitions under environmental conservation law

Requires the Department of Environmental Conservation, DMV, and Department of Transportation to modify vehicle inspection programs within 180 days to include visual inspections for aftermarket defeat devices

Mandates vehicle owners found with defeat devices remove them within 10 business days and submit written proof of removal within 15 business days, or face $1,000-$5,000 civil penalties

Establishes a $750 fine under vehicle and traffic law for operating diesel vehicles with defeat devices, with $450 waivable upon proof the emission system has been restored to proper working condition
