Allows courts to order mental health and/or substance abuse evaluations for defendants charged with non-bailable crimes, upon application from prosecutors, defense counsel, family members, mental health professionals, hospital directors, social workers, or probation/parole officers

Courts may require compliance with mental health or substance abuse treatment as a condition of pretrial release if evaluation determines treatment is needed

Imposes a 1% surcharge on all cash bail and bail bonds to fund the new "pretrial mental health and substance abuse services bail fund"

Requires police to make reasonable efforts to contact family members, mental health providers, and other specified individuals when they believe a person being arrested is suffering from mental health or substance abuse issues

Establishes the pretrial mental health and substance abuse services bail fund under the Commissioner of Taxation and Finance and State Comptroller to reimburse counties for evaluation and treatment costs
