Expands eligibility for the New York state organized militia tuition recruitment incentive program by allowing members with baccalaureate degrees to participate; only those with master's degrees or higher are now ineligible

Changes the benefit termination trigger from attainment of a baccalaureate degree to attainment of any post-secondary degree or diploma, allowing members to pursue graduate education

Named the "Technical Sergeant Joseph G. Lemm tuition benefit act" in honor of a fallen service member

Benefits continue to be suspended for failure to maintain good military standing, academic progress, or sufficient academic standing for other financial assistance

Takes effect immediately upon enactment
