Allows direct support staff in non-facility based programs certified by the Office for People with Developmental Disabilities (OPWDD) to perform certain nursing-related tasks under instruction from service recipients, family members, or household members

Requires a registered professional nurse to determine which tasks direct support staff may perform based on task complexity, staff skill/experience, patient health status, and whether the recipient/family can effectively train the staff

Mandates direct support staff complete OPWDD-required training and prohibits them from assessing medication needs or performing tasks outside a licensed practical nurse's scope of practice

Requires separate annual certification for staff providing medication administration, tube feeding, or diabetic care, and criminal/background checks for new hires prior to service provision

Takes effect 18 months after becoming law and expires July 1, 2030
