Establishes a legal presumption that lung diseases contracted by correction officers, correction supervisors, deputy sheriff patrol officers, and deputy sheriff patrol supervisors are job-related disabilities incurred in the line of duty

Applies to members of the New York State and Local Employees' Retirement System (NYSLERS) who passed a physical examination showing no lung disease prior to employment

The presumption can be rebutted only by competent evidence proving the contrary

Disability benefits vary by tier: Tiers 1-2 receive 3/4 of final average salary; Tiers 3-6 under Article 14-B receive 2/3 of final average salary; all other Tiers 3-6 receive 1/3 of final average salary (less Workers' Compensation where applicable)

Estimated costs range from 2 to 10 times salary depending on the member's prior benefit status, with costs shared by New York State and participating employers
