State agencies spending over $2 million annually on food must purchase at least 15% New York state food products by December 31, 2026, increasing to 20% by 2027, 25% by 2028, and 30% by 2029 and thereafter

"New York state food product" is defined as food grown, harvested, or produced in the state, or processed food comprising over 51% agricultural raw materials from New York by weight or volume

Bidders offering New York state food products may receive preference over other bidders if their bid is no more than 10% higher than competing bids

Agency heads may exempt purchases from these requirements if NY products would be against public interest, unreasonably expensive, unavailable in sufficient quantity/quality, or cause delivery delays

The Commissioner of the Office of General Services and Commissioner of Agriculture must review the procurement goals at least every three years and issue joint recommendations to the governor and legislature
