Grants residents of assisted living facilities and nursing home patients (or their lawful representatives if they lack capacity) the right to install, operate, and maintain electronic monitoring devices in their rooms at their own expense

Requires video/picture capture to be limited to the resident's or patient's "personal space," defined as the area including and immediately surrounding their bed, furniture, equipment, and possessions—excluding roommates' space and shared bathrooms

Mandates written consent from any roommate (or their lawful representative) before an electronic monitoring device can be installed; devices cannot be used without this consent

Requires additional written consent from roommates for audio recording, plus posting of a conspicuous notice at the room entrance warning that audio is being captured

Nursing homes must maintain documentation of electronic monitoring device installations and all required consents as part of the patient's record

Takes effect 30 days after becoming law
