Authorizes the New York State Board of Elections to deny certification to any candidate for office who has been found to have engaged in insurrection or rebellion against the United States, or given aid or comfort to its enemies

Candidates disqualified for insurrection may still be certified if Congress removes the disability by a two-thirds vote of each house, as provided under the 14th Amendment

Requires that when the State Board of Elections cannot reach a finding on the insurrection question, the matter must be referred to the Attorney General within 24 hours for a formal opinion

The Attorney General's opinion on candidate eligibility shall be conclusive unless overturned by a court of competent jurisdiction

Takes effect immediately upon passage
