Voting machines or systems in New York must comply with the Voluntary Voting System Guidelines (VVSG) adopted by the U.S. Election Assistance Commission on December 13, 2005 to receive state board approval

The compliance requirement applies only to components that record, cast, or tabulate votes, not to electronic poll books or accessible absentee ballot marking systems

The State Board of Elections must test all voting machines and systems against the federal VVSG standards before granting approval

Examiners and testing laboratories selected by the State Board of Elections must conduct examinations to ensure compliance with the 2005 federal guidelines

Local boards of elections may only adopt voting machines or systems that have been approved by the State Board of Elections after meeting these federal standards
