Creates four new degrees of package theft crimes in New York, ranging from fourth degree (Class A misdemeanor) for packages valued over $1 to first degree (Class B felony) when theft of marked medical packages causes serious adverse health conditions

Fourth degree package theft elevates to third degree (Class E felony) when property value exceeds $25, two or more packages are taken, or the person has a prior package theft conviction

Second degree package theft (Class D felony) applies when stolen packages contain prescribed medicine, medical devices, or medical device parts intended for the recipient or someone in their household, family, or care

Eliminates defenses based on unawareness of package contents, abandonment of the package after taking it, or lack of intent to cause harm in medical theft cases

Allows defenses when the accused genuinely believed the package was theirs, had authorization to take it, or there was a legitimate ownership dispute over the contents
