OH HB13

Prohibits Tier III sex offender/child-victim offenders with victims under 16 years old from knowingly being present on school premises or preschool/child day-care center premises, with affirmative defense for parents/guardians of enrolled children for legitimate purposes.

Creates new criminal penalties for violating the school premises prohibition: misdemeanor of the second degree on first offense, misdemeanor of the first degree on second offense, and felony of the fifth degree on each subsequent offense.

Requires sheriffs to provide written notice to affected Tier III sex offenders explaining the prohibition and legitimate purposes under which they may be present on school/preschool/child day-care premises.

Increases penalty for sexual imposition offense under division (A)(4) or (5) of section 2907.06 to misdemeanor of the first degree and establishes separate penalty structure for divisions (A)(1), (2), or (3).

Requires sex offender registries to include statement identifying which offenses subject an offender to the school premises prohibition under the new section 2950.035.
