Prohibits driving a motor vehicle, trackless trolley, or streetcar while using a handheld or manually operated mobile communication device on any street, highway, or public property open to vehicular traffic.

Exempts hands-free devices specifically designed for hands-free operation, emergency calls to law enforcement or health care providers, public safety vehicle operators using devices in their duties, citizens band or two-way radios, and stationary vehicles parked outside lanes of travel.

Defines mobile communication devices to include wireless telephones, text-messaging devices, personal digital assistants, computers, and any substantially similar wireless device designed to communicate voice, text, or data.

Establishes escalating fines: $25 for first offense, $50 for second or third offense, and $100 for fourth or subsequent offense.
