Prohibits employers from discharging, refusing to hire, or discriminating against employees based on tobacco smoking status in hiring, tenure, terms, conditions, or any employment-related matters.

Allows employers to enforce rules prohibiting employees from smoking tobacco or smelling like tobacco smoke during work hours.

Permits discriminated employees to sue in court for damages, costs, attorney's fees, and injunctive relief, with a one-year statute of limitations from the date of violation.

Assigns the Director of Commerce to administer and enforce the section and adopt related rules under Chapter 119 of the Revised Code.

Establishes penalties of $25,000 for first offense, $50,000 for second offense, and $100,000 for each subsequent offense for violations.
