H.B. 94 Summary

• Requires manufacturers and labelers of prescription drugs to report annually to the Ohio Director of Health the name and address of their compliance officer by January 1st.

• Mandates manufacturers and labelers submit detailed reports by February 1st disclosing the value, nature, and purpose of any gifts, fees, payments, subsidies, or other economic benefits provided to healthcare professionals, hospitals, nursing homes, pharmacists, and health benefit plan administrators in connection with drug marketing and detailing activities.

• Exempts from disclosure requirements: gifts valued under $25, sample drugs intended for patient distribution, clinical trial compensation, and scholarships for medical students attending professional conferences.

• Requires the Director of Health to submit a summary report to the governor and general assembly by June 1st each year summarizing all received manufacturer reports.

• Establishes penalties for violations including fines up to $10,000 per offense and authorizes the Attorney General to seek injunctive relief in Franklin County Court of Common Pleas.
