H.J.R. No. 3 Summary

• Proposes to add Section 43 to Article II of the Ohio Constitution, submitted to voters at the February 2, 2010 general election.

• Prohibits laws or rules from compelling any person, employer, or health care provider to participate in any health care system, either directly or indirectly.

• Allows persons, employers, and health care providers to pay for or accept direct payment for lawful health care services without incurring penalties, fines, taxes, or wage withholding.

• Permits purchase and sale of health insurance in private health care systems unless substantially limited by reasonable and necessary rules.

• Does not affect existing requirements for health care services, workers' compensation statutes, laws in effect as of January 1, 2009, or health care system terms that do not punish direct payment or providers accepting direct payment.
