S.B. 120 Summary

• Expands the definition of "retail tobacco store" to include cigar bars that meet specific equipment requirements (walk-in humidor of 300+ cubic feet, HEPA filtration, carbon filtration, carbon dioxide filtration, smoke eaters, and ozone machines).

• Creates a new exemption category for "family-owned and operated places of employment" defined as non-publicly traded businesses with family leadership, located in freestanding structures or separated by firewalls, and holding a liquor permit under Chapter 4303.

• Eliminates filing requirements for cigar bars to annually submit affidavits to the department of health regarding gross income percentages, while maintaining the requirement for other retail tobacco stores.

• Redefines "outdoor patio" to include any non-enclosed area not functioning as a parking lot and attached or adjacent to a building, with special provisions for correctional facilities.

• Simplifies exemptions for private clubs by requiring only that they be organized as not-for-profit entities and hold a valid D4 liquor permit if serving alcohol, removing previous restrictions on employees, minors, and structural requirements.
