OH SB149

Establishes the "State Recognition of Native American Tribes Act" by creating sections 185.01-185.07 of the Revised Code to define procedures for Ohio Civil Rights Commission recognition of native American tribes, groups, and special interest groups.

Defines "native American tribe" as indigenous groups with continuous presence in Ohio that meet recognition criteria; "native American group" as any native American aggregated entity not claiming tribal status; and "native American special interest group" as entities formed to advocate for native American issues.

Requires petitioners seeking tribal recognition to submit certification and statement to the commission affirming official petition status and meeting all recognition criteria; commission must approve or disapprove within 15 months with appeal rights to court of common pleas within 60 days.

Establishes six recognition criteria including identification as native American tribe since 1900, existence as distinct community, maintained political authority, current governing documents with membership lists, member descent from historical Ohio-indigenous tribes, and membership primarily of non-federally-recognized members.

Immediately confers state recognition upon the Shawnee Nation United Remnant Band based on findings from Am. Sub. H.J.R. 8 of the 113th General Assembly; clarifies state recognition does not qualify tribes for Indian Gaming Regulatory Act purposes.
