Enacts section 125.083 of the Revised Code to require state agencies to set aside approximately 20 percent of their annual purchases for competition by small business enterprises only.

Defines "small business enterprise" as any person with a principal place of business or research in Ohio that meets the requirements of a "business concern" under 13 C.F.R. 121.702.

Applies to the Department of Administrative Services and other state agencies, excluding the legislative and judicial branches, boards of elections, and the adjutant general.

If no small business enterprise submits a bid for a set-aside purchase, the agency shall use normal procedures and may set aside additional purchases to ensure the 20 percent aggregate target is achieved.

Establishes that intentionally misrepresenting ownership or control of a small business enterprise to obtain contracts under this section constitutes theft by deception under Ohio law; applies first to purchases made in fiscal year 2010.
