OH SB85

Authorizes county commissioners, conservancy districts, sanitary districts, regional water and sewer districts, and municipal corporations to enter into multi-year professional service contracts for water storage tank engineering, repair, sustainability, water quality management, and maintenance through direct negotiation or requests for proposals.

Requires contracts to limit annual payments to the excess of the political subdivision's water utility charges over operating expenses and outstanding debt service charges for that year.

Mandates that all work be supervised by a licensed professional engineer under Ohio law who certifies compliance with applicable codes and engineering standards.

Specifies that work necessary to bring tanks or facilities into federal, state, or local compliance must be itemized separately and paid over a minimum three-year period, after provisions for operating and debt service expenses.

Exempts these contracts from standard competitive bidding requirements that normally apply to municipal corporations, conservancy districts, sanitary districts, counties, and regional water and sewer districts.
