• Proposes to add Section 43 to Article II of the Ohio Constitution to protect individual health care rights and choices.

• Establishes that people have the right to enter into private contracts with health care providers and purchase private health care coverage.

• Prohibits the General Assembly from requiring any person to participate in any health care system or plan.

• Prohibits the General Assembly from imposing penalties or fines of any type for choosing to obtain or decline health care coverage or for participation in any particular health care system or plan.

• Requires three-fifths approval from both houses of the General Assembly and submission to voters at the November 3, 2009 general election; takes effect immediately upon voter approval.
