S.J.R. No. 7 Summary

• Proposes adding Section 43 to Article II of the Ohio Constitution to be submitted to voters at a special election on February 2, 2010.

• Prohibits any law or rule from compelling a person, employer, or health care provider to participate in any health care system, either directly or indirectly.

• Allows persons and employers to pay directly for lawful health care services without penalties or fines, and permits health care providers to accept direct payment without penalties or fines.

• Permits the purchase or sale of health insurance in private health care systems subject to reasonable rules that do not substantially limit a person's options.

• Exempts from the amendment: existing laws as of August 1, 2009; workers' compensation statutes; and health care system terms that do not punish direct payment or providers accepting direct payment for lawful services.
