Amends Ohio Constitution Article XV, Section 6 to authorize private operation of state lottery and allow lottery net profits to fund higher education scholarships in addition to current K-12 education support.

Authorizes casino gaming at four facilities in Cincinnati, Cleveland, Columbus, and Toledo, with a 33% tax on gross casino revenue distributed to counties (51%), school districts (34%), host cities (5%), casino control commission (3%), horse racing (3%), law enforcement training (2%), and problem gambling treatment (2%).

Requires each casino operator to pay $50 million upfront license fee per facility ($200 million total) and make minimum $250 million investment per casino ($1 billion total statewide).

Establishes Ohio Casino Control Commission with seven members appointed by governor with senate approval to license and regulate casino operators, management companies, key employees, and gaming vendors.

Becomes effective January 1, 2011, if approved by voter majority at November 2, 2010 general election.
