Summary of HB189

• Prohibits manufactured home park operators, condominium associations, neighborhood associations, and landlords from restricting the display of the United States flag when displayed in accordance with federal flag code (4 U.S.C.A. 5-10), federal/state law, local ordinances, or presidential/gubernatorial proclamations.

• Prohibits the same entities from restricting the display of service flags (blue star banners, gold star banners, and other flags approved by the U.S. Secretary of Defense) in windows of residences of immediate family members of armed forces personnel.

• Establishes that any rental agreement provision or covenant violating these protections is against public policy and unenforceable as an unconscionable term.

• Creates new restrictions on manufactured home park operators including mandatory one-year lease offers to owners, full fee disclosure prior to occupancy, 30-day notice requirements for fee/rule changes, and prohibition of fee increases during lease terms.

• Protects home owners' rights to sell homes within parks with 10 days' notice and prohibits operators from charging transfer fees except for actual moving and installation costs.
