HB 381 Summary

• Amends Ohio Revised Code Section 3313.41 to require school districts to first offer real property to state universities or the Northeast Ohio Medical University (with main or branch campus in the district) before disposing of property through other means.

• Offers to universities must include: property "as is" in exchange for in-kind services/educational programs valued at fair market value, or sale at a price not exceeding appraised fair market value.

• Universities have 60 days to accept an offer; if they decline or do not respond, the school district may then offer the property to community school governing authorities under Chapter 3314.

• If community schools do not accept within 60 days, the school district may dispose of the property through public auction, private sale, or other methods specified in existing law.

• Maintains existing provisions for school districts to donate property valued at $2,500 or less to eligible nonprofit organizations and to exchange property for school purposes.
