Enacts section 125.083 of the Revised Code to require state agencies to set aside approximately 20% of purchases for competition by small business enterprises only.

Defines "small business enterprise" as any person with a principal place of business or research in Ohio that meets the requirements of a "business concern" under 13 C.F.R. 121.702.

Applies to the Department of Administrative Services and all other state agencies except the legislative and judicial branches, boards of elections, and the Adjutant General.

Allows purchases set aside for small businesses to be made through normal competitive procedures if no small business submits a bid, and requires agencies to set aside additional purchases to ensure the 20% target is met annually.

Makes intentional misrepresentation of ownership or control of a small business enterprise to obtain contracts a criminal offense under theft by deception laws, and becomes effective for purchases in fiscal year 2011.
