School district boards may adopt resolutions to solicit bids and award contracts for selling commercial advertising space on the outside surfaces of school buses, with advertisements displayed as attached signs rather than painted on the bus.

Board procedures must limit advertising sales to for-profit entities only and prohibit advertisements for alcohol, tobacco, gambling, sexual content, political candidates, public offices, or ballot issues.

A district committee composed of administrators and attorneys must approve all school bus advertisements sold by the district.

School districts may negotiate provisions in leases or contracts for privately owned buses to allow the district to sell advertising space on either side of the bus under the same restrictions.

School buses displaying compliant advertising shall not fail state highway patrol inspection solely because of the advertisement, and regulations adopted by the Department of Public Safety cannot restrict a board's ability to display such commercial advertising.
