SB 293 Summary

• Prohibits automobile insurers from enforcing intrafamily exclusions when an insured person, their spouse, or a relative dies as a direct result of an accident in which the insured was not at fault.

• Applies only to accidents meeting both conditions: the insured person bears no fault and a family member dies as a proximate result of the accident.

• Defines "intrafamily exclusion" as any policy provision that excludes coverage for bodily injury or death of spouses, resident relatives, or other relatives, including under uninsured and underinsured motorist coverage.

• Amends section 3937.18 of the Ohio Revised Code regarding motor vehicle insurance coverage and enacts new section 3937.46 establishing the restrictions on intrafamily exclusions.
