SB 313 Summary

• Amends procedures for school districts disposing of real property by requiring them to first offer property to state universities or the northeast Ohio medical university with a main or branch campus in the district before other disposal methods.

• Offers two options for university acquisition: (1) property in "as is" condition in exchange for in-kind services, educational programs, or assistance valued reasonably related to appraised fair market value, or (2) sale at price not exceeding appraised fair market value.

• Provides 60-day period for universities to accept the offer; if declined or no agreement reached, the school district board then offers the property to charter school (community school) governing authorities at not more than appraised fair market value.

• Maintains existing procedures for property disposition after university and charter school offers are exhausted, including public auction requirements and private sale options per current law.

• Preserves all other existing property disposal mechanisms including trades, exchanges for school purposes, and donations to eligible nonprofits with fair market value of $2,500 or less.
