Eliminates the requirement that school districts provide all-day kindergarten to all enrolled kindergarten students beginning in fiscal year 2011.

Allows school districts that did not receive poverty-based assistance for all-day kindergarten in fiscal year 2009 to charge fees or tuition for all-day kindergarten, with districts required to develop a sliding fee scale based on family income.

Permits school districts to operate all-day or extended kindergarten on a voluntary basis rather than as a mandatory program.

Requires the Department of Education to conduct annual surveys of eligible districts to track whether they charge tuition for all-day kindergarten and enrollment numbers between half-day and all-day options.

Repeals related provisions from previous legislation (Am. Sub. H.B. 1 and Sub. H.B. 318 of the 128th General Assembly) that mandated all-day kindergarten implementation, effective July 1, 2011 or the earliest date permitted by law.
