S.B. No. 92 Summary

• Creates a highway safety education fund in the state treasury, consisting of portions of fines collected from traffic violations related to assured clear distance ahead and right-of-way violations.

• Increases penalties for violations of assured clear distance ahead (section 4511.21) and failure to yield right-of-way provisions (sections 4511.33, 4511.41-4511.47) when such violations result in serious physical harm or death to another person.

• When violations result in serious physical harm, courts must impose fines up to $500, a class eight license suspension, and 2-4 points on the driver's license; courts must forward the first $25 of fines to the highway safety education fund.

• When violations result in death, courts must impose fines up to $1,000, a class seven license suspension, and 2-6 points on the driver's license; courts must forward the first $50 of fines to the highway safety education fund.

• Authorizes law enforcement to issue citations for traffic violations that result in serious physical harm or death to another person based on accident investigation, and requires offenders to appear in person in court rather than enter written pleas of guilty.
