SJR 3 Summary

• Proposes constitutional amendments to restrict General Assembly authority to amend or repeal laws subject to pending referendums or initiatives during the 90-day referendum period and two years following voter approval or rejection.

• Prohibits the General Assembly from amending laws enacted by voter initiative for two years after approval unless approved by a two-thirds vote in both chambers.

• Prevents the General Assembly from reenacting provisions rejected by voters in a referendum for two years following the vote, unless approved by a two-thirds vote in both chambers.

• Extends the signature-gathering period for referendum petitions to 90 days if a court upholds the right to refer a law that was previously challenged as non-referable.

• Amendment scheduled for voter approval at the November 6, 2012 general election; if adopted, takes effect immediately.
